SAMPLE VACATION RENTAL LEASE 2008

The LANDLORD hereby leases to the TENANT the premises located at:
50 Lantern Lane,
Vineyard Haven, MA 02568


This lease shall begin at 4pm on (DATE _______) and end at 10am (DATE ________).  These times can be adjusted longer if there are no tenants before or after your arrival.


For such term, the TENANT agrees to pay$________ which includes utilities, such as water, gas, oil and electricity, cable, DSL and services such as trash removal, and house cleaning.


The LANDLORD hereby acknowledges receipt from the TENANT  (HALF THE RENT $_________) to secure this time on the availability calendar on the web site VineyardCape.com

Thirty days before arrival (DATE____________) the last half of this rent  $________) will be paid, together with the $300.00 damage deposit.  This check, should be made out to Peggy Dickinson, and mailed to the address above.


SECURITY DEPOSIT of $300, will be returned 3 days after departure.


If there is a circumstance that prevents your arrival, I will relist the vacation week.  If re-rented, I will return 100% of the rent, and 100% of the security deposit.


The LANDLORD has a cleaning & inspection service, through Marcia de Souza.  If there is anything less than perfect, feel free to call her at 508-___-_____, or me at the phone number above.


The parties hereto in consideration of these presents, agree as follows:


1.      That no more than 6 persons will occupy said premises.  A well-behaved family dog is welcome.


2.      The TENANT will be responsible for only excessive damage or breakage and/or loss to the premises. Normal wear and tear and unavoidable casualty that may result from occupancy is not a factor.


3.      The TENANT will leave the premises in the same general and good and habitable condition.  This includes:


a.    starting the linen in the washing machine in the morning of departure.
b.    empty refrigerator & gathering of trash to the outside bin.
c.     placing 2 remotes on downstairs TV and one remote on headboard of upstairs TV.
d.    and returning keys to basket.


4.      The LANDLORD will supply the TENANT’S linen, towels and extra blankets.


5.      If the TENANT defaults and/or otherwise fails to comply as regards any item in this lease, the TENANT agrees to vacate said premises upon receipt of proper notice from LADLORD an /or upon proper commencement and final adjudication of proceedings authorized and/or required by the applicable laws and regulations of the Commonwealth of Massachusetts.


6.      The TENANT agrees to allow the LANDLORD or his agent to reasonably enter and view the premise, both inside and outside: A) to inspect the premises; B) to make repairs thereto: C) pursuant to a court order; and D) to protect the premises if it appears that said premises have been abandoned by the TENANT.


7.      The TENANT and LANDLORD agree that should the premises be destroyed by fire or other casualty so as to become unfit for human habitation that these presents shall be ended, with refund to the TENANT  for any rent unused.


8.      The LANDLORD agrees to supply fixtures and household furnishings, equipment or other personal property only as represented at the time of the initial showing and when the initial deposit is made.


9.      The LANDLORD and TENANT state that the rental of these premises is for a vacation purpose as expressed in MASSACHUSETTS GENERAL LAWS C. 186 15B (9).



10.   The TENANT agrees that it shall be the TENANT’S obligation to insure the TENANT’S personal property and the keeping of said personal property on the premises shall be at the sole risk of the TENANT.


11.   The TENANT agrees to indemnify and to hold the LANDLORD harmless from any and all liability, loss or damage arising out of the occupancy of the leased premises by the TENANT, or the TENANT’S family, guests, licensees, and /or invitees.


13.   In the event that the TENANT must cancel plans to reside at the rental property, the LANDLORD shall be notified by email, as soon as possible.  Every effort will be made by LANDLORD to find another suitable TENANT to occupy the property.  If successful, the TENANT will be refunded 100% of rent.  If a suitable replacement TENANT is not found, the TENANT named herein shall be bound by this lease agreement.

if canceled 60 days before arrival, full refund of the half rent send in to hold reservation.


14.   No surrender or acceptance of surrender of the leased premises shall be valid, unless so stipulated in writing by the LANDLORD.


15.   The TENANT shall not assign or sublet or permit the leased premises or any part thereof to be used by others (except the TENANT named herein, the TENANT’S spouse, children, nanny and guests for visits not to exceed one week), without the prior written consent of the LANDLORD in each instance.

16.   The TENANT and LANDLORD agree that should legal proceedings be deemed necessary and proceed, they shall proceed in the County of Dukes County, Massachusetts.
